Terms of use

Applies to Filigree for iPhone and iPad, on top of Apple’s standard license for App Store apps.

  1. 01

    Who we are

MARETHIC is the name under which Marek Roslik, a sole trader (jednoosobowa działalność gospodarcza) based in Poland, publishes apps. It is not a company. In these terms, “MARETHIC”, “we” and “us” mean him, and “you” means the person using Filigree. Questions, complaints and claims go to [email protected].

  2. 02

    Agreement

These terms apply to Filigree. By downloading, installing or using the app you agree to them; if you do not agree, do not use it. The MARETHIC website and other MARETHIC apps have their own terms and policies. Section 03 explains how these terms relate to Apple’s license.

  3. 03

    Apple’s license

Filigree is distributed through the App Store and licensed to you under Apple’s Licensed Application End User License Agreement (the “Apple EULA”, apple.com/legal/internet-services/itunes/dev/stdeula). These terms supplement it. If the two conflict, the Apple EULA prevails, unless these terms give you more rights. You must also follow the App Store’s usage rules and any third-party terms that apply when you use the app, such as those of your mobile carrier.

  4. 04

    Apple’s role

These terms are between you and MARETHIC, not Apple. MARETHIC, not Apple, is responsible for Filigree, its content, its maintenance and support, and for handling any claim about it — including product liability claims, claims that it does not conform to legal or regulatory requirements, consumer protection and privacy claims, and claims that it infringes someone’s intellectual property. If Filigree fails to conform to a warranty that applies to it, you may notify Apple, and Apple may refund its purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

  5. 05

    License

MARETHIC grants you a personal, limited, non-exclusive, non-transferable, revocable license to use Filigree on Apple devices that you own or control, as the App Store usage rules allow, for as long as you comply with these terms. Filigree is licensed, not sold: MARETHIC and its licensors keep all rights in the app that these terms do not expressly grant to you.

  6. 06

    What you may not do

Except as the law expressly allows despite this restriction, you may not copy, modify, translate, decompile, disassemble or reverse-engineer Filigree or any part of it; remove or bypass its subscription checks or other technical limits; extract its built-in shapes, brushes, artwork, images or code to distribute them on their own; rent, lease, sell, sublicense or redistribute the app; or use it to build a competing product.

  7. 07

    Free features and Filigree Pro

Filigree is free to download and includes a set of free features. Filigree Pro is an optional auto-renewing subscription that unlocks additional features; what it includes is described in the app before you buy. Filigree Pro is offered monthly or yearly and has no free trial unless the App Store says otherwise at the time of purchase.

  8. 08

    Payment and renewal

Filigree Pro is sold by Apple through the App Store, and payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically for the same period unless you turn off auto-renewal at least 24 hours before the end of the current period; your account is charged for the renewal within the 24 hours before that end. You can manage or cancel it in Settings → your name → Subscriptions on your device. Cancelling stops the next renewal, and Pro stays on until the end of the period you paid for. MARETHIC uses RevenueCat to keep track of which subscriptions are active and never sees your payment details.

  9. 09

    Prices

Prices are set per App Store region, shown in the App Store and in the app before you buy, and may include taxes as Apple applies them. MARETHIC may change the price of Filigree Pro for future periods. A change never affects a period you have already paid for; Apple tells you about a price increase before it applies and, where its rules or the law require, asks for your consent, and you can cancel before the new price takes effect.

  10. 10

    Refunds

Purchases are made from Apple, so refunds are decided by Apple under its terms; you can request one at reportaproblem.apple.com. MARETHIC cannot issue refunds for App Store purchases itself. This does not limit any right to a refund or price reduction that the law gives you.

  11. 11

    Right of withdrawal

If you are a consumer in the EU, you have a statutory right to withdraw from a purchase of digital content within 14 days. Purchases of Filigree Pro are made from Apple, and Apple’s Media Services Terms set out how this right is used and when it ends once you start using the content; you can make the request at reportaproblem.apple.com, or write to [email protected].

  12. 12

    When Pro ends

If your subscription ends or is refunded, the features that need Filigree Pro lock again. Your drawings stay on your device and keep opening, including the layers, symmetry modes and other Pro features already in them, but exporting and sharing a drawing, and other Pro actions, need an active subscription again.

  13. 13

    Your drawings

Anything you create in Filigree — drawings and anything else you make — is yours, and you may use it for any lawful purpose, including commercially. MARETHIC claims no rights to it and, unless a feature clearly says otherwise, never receives it. You may use Filigree’s built-in shapes, brushes and patterns as part of drawings you make, but not distribute them on their own (section 06).

  14. 14

    What you import and share

You are responsible for the photos and other material you bring into Filigree and for what you export, share or publish from it. Import only material that you own or have the right to use, and do not use the app to create or share content that infringes someone else’s rights or breaks the law. MARETHIC does not see, review or monitor your content and is not responsible for it, or for what happens to it once you share it outside the app.

  15. 15

    Backups and data loss

Filigree stores your drawings only on your device; it has no account and no cloud storage of its own, so MARETHIC cannot see, back up or recover them. Deleting the app, resetting or losing your device, a failed update or a storage fault can delete them. You are responsible for keeping your own copies — for example with your device’s backup or by exporting drawings you want to keep. To the extent permitted by law, MARETHIC is not liable for drawings lost because no backup was kept; this does not apply to loss caused by MARETHIC’s intent or gross negligence, or to your statutory rights if the app does not conform to the contract.

  16. 16

    Intellectual property

Filigree and everything in it other than your own content — including the code, design, built-in shapes, brushes, artwork, text and the names and logos “Filigree” and “MARETHIC” — belong to MARETHIC or its licensors and are protected by copyright, trademark and other laws. These terms give you no right to use those names or logos. Open-source components in the app are licensed under their own licenses, which prevail for those components.

  17. 17

    Copyright and other complaints

If you believe that something in Filigree or its App Store listing — a built-in shape, brush, image, text or other material — infringes your copyright, trademark or other rights, write to [email protected] before taking any other step. Describe the material and where it appears, the right you hold, and how to reach you. MARETHIC will review every complaint in good faith and reply within 14 days; where the complaint is justified, it will remove or change the material, normally in the next update of the app. Both sides agree to try to settle such a matter this way first, and to start legal proceedings only if it has not been resolved within 30 days of the complaint. This does not limit anyone’s right to seek urgent interim relief from a court, or your statutory rights as a consumer. MARETHIC does not host what users draw or share: a complaint about content that a user has published belongs with that user or the service where it was published.

  18. 18

    Feedback

If you send ideas, suggestions or other feedback about Filigree, MARETHIC may use them freely, without any obligation or payment to you, and you grant MARETHIC a worldwide, perpetual, irrevocable, royalty-free license to do so. This does not apply to your drawings, and MARETHIC will not publish your name or anything that identifies you without your permission.

  19. 19

    Acceptable use

You agree not to use Filigree to break the law or infringe anyone’s rights; to interfere with its operation or security, or with the services it relies on; or to attempt to gain access to systems, data or features that are not yours, including by bypassing the subscription.

  20. 20

    Third-party services

Filigree relies on services run by others: Apple (the App Store, payments, iCloud Backup, the photo picker and other system features), Google (Firebase) and RevenueCat. They are provided under their own terms and privacy policies, which apply to your use of them. MARETHIC does not control them and, to the extent permitted by law, is not responsible for their availability, their content or how they act, including an App Store outage or Apple’s decisions about your purchase or refund. Links to third-party websites are provided for convenience only.

  21. 21

Updates and changes to the app

MARETHIC may update Filigree, change or remove features, or change what the free version and Filigree Pro include, for valid reasons: to fix errors or security issues; to follow changes in law, in Apple’s rules or in the services the app relies on; to keep the app compatible with new devices and iOS versions; or to improve or develop the app. A change during a paid period comes at no extra cost, and you will be told about it clearly, for example in the release notes. If you are a consumer and a change to Filigree Pro negatively affects your access to it or its use in more than a minor way, you may end your subscription free of charge within 30 days of being told, or of the change, whichever is later, and get a proportionate refund for the unused part, as the law provides. Updates may require a recent version of iOS or iPadOS.

  22. 22

    Discontinuation

MARETHIC may stop offering or supporting Filigree. It will give at least 30 days’ notice of discontinuation through the App Store listing, the release notes or marethic.com, and will stop selling new subscriptions when it does. A period you have already paid for is not affected by the notice; if Filigree Pro stops being provided before the end of a paid period, you keep your statutory rights, including to a proportionate refund. MARETHIC does not promise that an app it no longer supports will keep working on future versions of iOS or iPadOS.

  23. 23

    Suspension and termination

You may stop using Filigree at any time by deleting it and cancelling your subscription. MARETHIC may suspend or end your license if you seriously or repeatedly break these terms — for example by bypassing the subscription, redistributing the app or using it unlawfully — and, where it can, will first tell you and give you a chance to stop. When the license ends, you must stop using the app. Sections that by their nature should survive — including 13 to 18, 20 and 24 to 35 — survive the end of these terms.

  24. 24

    Your statutory rights

If you are a consumer, nothing in these terms limits the rights that mandatory law gives you. In particular, if you are a consumer in the EU, the EEA or the UK, MARETHIC is responsible under the law for supplying Filigree Pro and for it conforming to the contract, including the statutory rights to have the app brought into conformity, to a price reduction or to end the contract; sections 25 and 26 do not limit those rights. Where these terms say “to the extent permitted by law”, a limitation applies only as far as the law that protects you allows it.

  25. 25

    Disclaimer

Subject to section 24 and to the extent permitted by law, Filigree is provided “as is” and “as available”. MARETHIC makes no warranties beyond those the law requires — express, implied or statutory — including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation, and does not promise that the app will work with every device or iOS version or that any error will be fixed. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

  26. 26

    Limitation of liability

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for intent or gross negligence, for injury to life, body or health, for fraud, and for your rights as a consumer under mandatory law (section 24). Subject to that and to the extent permitted by law: MARETHIC is not liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue, business opportunities, goodwill or data, however caused, even if it was told they were possible; and MARETHIC’s total liability for all claims relating to Filigree is limited to the greater of the amount you paid for Filigree Pro in the twelve months before the event giving rise to the claim and fifty US dollars (USD 50). Some jurisdictions do not allow these exclusions or limits, so they may not apply to you.

  27. 27

    Indemnity

If you use Filigree for business or professional purposes, you will indemnify MARETHIC against claims, losses and reasonable costs, including legal fees, arising from content you import, create, export or share, or from your breach of these terms or of anyone’s rights. If you are a consumer, you are responsible for such claims only as far as the law makes you liable for them.

  28. 28

    Events beyond control

MARETHIC is not liable for a failure or delay caused by events beyond its reasonable control — such as outages of Apple, Google, RevenueCat or the internet, natural disasters, war, epidemics, cyberattacks or acts of government — for as long as the event lasts. This does not affect your statutory rights as a consumer if the app is not supplied or does not conform to the contract.

  29. 29

    Export and sanctions

You may not use, export or re-export Filigree except as authorized by United States law, EU law and the laws of the place where you obtained it. By using the app, you confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government or EU list of prohibited or restricted parties.

  30. 30

    Age

You may use Filigree if you can lawfully accept these terms, or with the permission and supervision of a parent or guardian who accepts them for you. Purchases are subject to Apple’s rules for your Apple Account, including Family Sharing and Ask to Buy. Filigree is not directed at children under 13 (Privacy policy, section 17).

  31. 31

    Governing law

Matters covered by the Apple EULA are governed by the law it names. Everything else in these terms is governed by the laws of Poland, without regard to conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of the protection of the mandatory laws of the country where you live.

  32. 32

    Disputes

If you have a problem with Filigree, write to [email protected] first: most issues can be solved that way, and MARETHIC will reply within 14 days. Disputes that are not resolved go to the competent courts of Poland. If you are a consumer, you may also bring a claim in the courts of the country where you live, and MARETHIC may sue you only there; if you live outside the EU, EEA and UK, you may also bring an individual claim in a small claims court where you live, if it has jurisdiction. These terms contain no arbitration agreement, and nothing in them limits your right to go to court.

  33. 33

    Changes to these terms

MARETHIC may change these terms for valid reasons: to reflect changes in the law, in Apple’s rules or in the services Filigree relies on; to describe new or changed features; to improve security; or to make the terms clearer. The date at the top is updated, and material changes are announced in the app’s release notes or on marethic.com before they apply. If you do not agree with a change, stop using Filigree and cancel your subscription; a change never affects a period you have already paid for. If you keep using the app after a change takes effect, the updated terms apply.

  34. 34

    Entire agreement and order

These terms, the Apple EULA and the Privacy policy are the whole agreement between you and MARETHIC about Filigree. They do not exclude what MARETHIC states about Filigree in its App Store listing and in the app, which forms part of what you can expect from it under consumer law. If these terms conflict with the Apple EULA, the Apple EULA prevails unless these terms give you more rights.

  35. 35

    Other legal terms

If a court finds part of these terms invalid or unenforceable, the rest stays in effect, and that part is replaced by the applicable statutory rule. If MARETHIC does not enforce a right, it does not waive it. You may not transfer your rights under these terms. MARETHIC may transfer them only together with Filigree, for example if the app is sold, and only to someone who takes on its obligations to you; you will be told about the transfer, and it never reduces your rights. Headings are for convenience only, and “including” means “including without limitation”.

  36. 36

    Contact

Questions, complaints and claims about these terms go to [email protected] or through the Contact page.
